Ping Lacson said Speaker Gloria Macapagal-Arroyo (GMA) may be charged for falsification
for signing the modified version of the proposed national budget for 2019.
A doctor of laws whom I often consult readily described Lacson’s
attack as MALICIOUS and an act of ARROGATING LEGAL EXPERTISE to himself when he
is NOT EVEN A LAWYER. The doctor of laws explained:
Under the Revised Penal Code, there must be criminal intent in
falsification. But GMA was only performing her function as Speaker of the House
of Representatives when she signed the modified version. GMA did not even have
anything to do with preparation of the modified version. So where is the
criminal intent?
Besides, the modified version which GMA signed will still have to
go through the Senate, then to the Bicameral Conference Committee and finally,
to President Duterte for his signature. Until that happens, GMA’s act did not result
in any damage to the government, the public documents system or to any person.
The doctor of laws agreed with me when I said therefore, there is
no basis whatsoever to charge GMA as Lacson sweepingly claim.
