THE REAL THREAT FROM THE CYBERCRIME ACT

Two OPPRESSIVE reasons continue to sound the ALARM FOR US to fight the Cybercrime Act.

First, the Cybercrime Act emits an aura of LUST FOR POWER on the part of the government.

Remember, under the Act, Justice Sec, Leila de Lima has the power to block one’s access to any Internet site, or close the site altogether, if SHE THINKS that the writer and the site are violating the law.

Take note, De Lima’s mere evaluation is enough. No need for a hearing in, or ruling by the court.

Consider this, boys and girls:

I’m not a lawyer but I’m 1001 percent sure that for our constitutional rights to be controlled or taken away from us, like the right to travel and the right to vote, THERE MUST BE A COURT ORDER.

But in the case of the Cybercrime Act, De Lima, and for that matter the government, have the power to PREJUDGE AND PUNISH ANYONE whom they deem as a violator, of the Act, even if trial has not started yet.

So if this is not lust for power, PNoy could have VETOED this DICTATORIAL provision of the Act.  But HE DID NOT. So if anybody thinks there’s a more appropriate description, I’m waiting.

Just be sure your defense won’t be an EMPTY, SENSELESS argument.

I perfectly agree that Internet writers should not be too abusive or insulting with their posts.

But it’s only the court which should have the SOLE POWER TO DECIDE if a person has violated the law or not, and then impose the corresponding penalty after trial.

NOT BEFORE a trial, like what the Cybercrime Act has empowered De Lima with.

Even if the Act is amended with reduced jail time for convicted violators, to which PNoy has said he is amenable to, the FACT REMAINS that the government, through De Lima, is now telling us indirectly to TONE DOWN OR SHUT UP.
