PRO AND ANTI-MARCOS, READ THIS!
I just got these key clarifications from a law
professor on the burial of former President Ferdinand Marcos (FM) at the Libingan
ng mga Bayani. Pro and anti-Marcos groups, read this carefully. Antis, ask your
leaders and lawyers for comment. Then, ask for the basis for your continued
protest rallies.
On Edcel Lagman’s contention that Armed Forces
regulations cannot be applied on the FM burial because these were not
published:
Book 7, Chapter 1, Section 1 of the Administrative
Code clearly says the Armed Forces is exempted from the publication
requirement, along with Congress, the Judiciary and several others.
Article 89 of the Revised Penal Code says that death
extinguishes all criminal liabilities. And until FM died, he has not been
convicted of any criminal act. The judgment against the Marcos Estate in the US
was CIVIL in nature.
On the demand for exhumation of FM’s remains: ONLY
a final, FAVORABLE judgment by the Supreme Court on a motion for recommendation
can allow it. Nothing else. The antis can demand for the exhumation as loud as
they like for as long as they like. But that never be enough.
