Sen. Teofisto Guingona will file a petition with the Supreme Court
today to declare as unconstitutional the Cybercrime Prevention Act of 2012.
In joining the growing clamor for the Act to be declared as
unlawful, Guingona said the Cybercrime Prevention Act contains provisions that
violate the 1987 Constitution.
He said the Act contains confusing and vague provisions that
suppress the citizens’ right to freedom of speech and expression.
“Without a clear definition of the crime of libel and the persons
liable, virtually, any person can now be charged even if you just like, retweet
or comment on an online update or blogpost containing criticisms,” Guingona
said.
Guingona added that the Act violates the rule on double jeopardy
because a person can be prosecuted for the same offense under the Cybercrime
Prevention Act and the Revised Penal Code.###
