GWEN GARCIA CAN STILL BE FORCIBLY EVICTED!


For those who don’t know, suspended Cebu Gov. Gwen Garcia can still be forcibly removed from her office at the provincial capitol despite the oral arguments for her petition for a temporary restraining order set by the Court of Appeals (CA) on Jan.10.

A law professor from the Philippine Christian University and the University of the Philippines explained to me that a separate restraining order by a court would have to be issued to prevent that from happening.

This is where it gets interesting, boys and girls:

First: If the PNoy Government bodily evicts Garcia before the CA renders a decision, that means they DO NOT PRACTICE COURTESY towards a co-equal branch of government (PNoy represents the Executive, the CA the Judiciary).

KAPAG BINALE-WALA ng PNoy Government.ang CA, ibig sabihin lamang ay BINASTOS NILA ang Judiciary at UTAK DIKTADOR na sila na kung ano ang magustuhan nila ay dapat agad matupad  at WALA NANG PROSE-PROSESO.

Second:  Only a written order from DILG Sec. Mar Roxas can allow Garcia’s physical ejection from her office.  But personally, I doubt Roxas will have the BALLS to write one.

If Roxas okays Garcia’s eviction in writing and, God forbid,  it turns violent and bloody, he will be the FIRST AND ONLY ONE TO BLAME!  Unless he can present physical proof that he had been ordered to do so by PNoy, WHO’S THE ONLY ONE HIGHER than him.

An authorization which PNoy is definitely NOT STUPID enough to give.

Especially considering the fact that support for Garcia REMAINS VISIBLE, as shown by the round-the-clock presence of her supporters at the capitol and the attendance of some 1,000 others to a rally she had called for following reports of a plan to take her out last Dec.31.

And to date, NOT A SINGLE RALLY has been held in support of Garcia’s suspension.,

So Roxas knows that not only will he be the FALL GUY, he can also kiss his 2016 presidential dream goodbye if blood flows or people get hurt in the Garcia standoff.,

Which leads me to the third consideration, guys.

If Roxas won’t do it, then who would and in exchange for what?  Garcia’s eviction is still a big possibility.

The longer it drags on, the more WEAKLING the image of PNoy and his government appears to be. And with the oral arguments set by the CA, the more legally questionable it has now become.

Otherwise, the CA would have readily denied Garcia’s petition for a TRO if it did not find any merit in her defense.  

If PNoy’s Government can OUTRIGHTLY IGNORE the Supreme Court temporary restraining order which would have allowed former President Gloria Macapagal-Arroyo to seek medical treatment abroad, it can do it again to a lower court.

Keep that in mind, guys! And better start thinking of your personal options whatever happens next, either right after or in the May polls.

  1. Garcia's case is a litmus test for Penoy Admin. Whatever the result will surely reflect on May & 2016 elections. Kaya tumatagal ang stand-off kc pinapakiramdaman nila ang pulso ng Cebuanos at ng buong bayan.

  2. You got it right again, Boyet. All things mentioned are just so logical. 2.4 million Cebuano votes is just too many to ignore - this is what the LP and UNA are fighting about.
